1. Introduction

Welcome to White Africa (“we,” “us,” or “our”), a classified marketplace platform operated by Eyooly Technologies Limited (“Eyooly”). These Terms of Service (“Terms”) govern your access to and use of the White Africa website, mobile applications, and services (collectively, the “Platform”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Definitions

“User,” “you,” or “your” refers to any individual or entity that accesses or uses the Platform.
“Seller” refers to a User who posts listings on the Platform.
“Buyer” refers to a User who browses, contacts sellers, or purchases items through the Platform.
“Listing” refers to any advertisement, post, or content submitted by a Seller to the Platform.
“Services” refers to all features, tools, and functionalities provided by the Platform.

3. Eligibility

To use the Platform, you must:

Be at least 18 years old or the age of majority in your jurisdiction.
Have the legal capacity to enter into binding contracts.
Not be prohibited from using the Platform under applicable laws.
Provide accurate, complete, and current information during registration.

4. Account Registration and Security

4.1 Account Creation

You may need to create an account to access certain features of the Platform. You agree to provide accurate and complete information and to keep this information updated.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms.

5. Listings and Content

5.1 Prohibited Items

The following items and services are strictly prohibited on the Platform:

Illegal drugs, weapons, explosives, or hazardous materials
Counterfeit goods or items that infringe intellectual property rights
Stolen property or items with removed serial numbers
Adult services, escort services, or sexually explicit content
Animals protected under wildlife conservation laws
Human remains or body parts
Gambling services or equipment (where prohibited by law)
Items promoting hate speech, discrimination, or violence
Any item or service prohibited by applicable law in your jurisdiction

5.2 Content Standards

All listings must:

Be accurate and not misleading
Include clear, truthful descriptions and images
Be placed in the appropriate category
Not contain defamatory, abusive, or harassing content
Not contain spam, malware, or phishing links

5.3 Intellectual Property

By posting a listing, you represent that you have the right to sell the item and that the listing does not infringe on any third-party intellectual property rights.

6. Transactions Between Users

6.1 Platform Role

White Africa operates as a classified marketplace and does not take ownership of items listed on the Platform. We are not a party to transactions between Buyers and Sellers.

6.2 Buyer Responsibilities

Verify the condition and authenticity of items before purchase
Meet sellers in safe, public locations
Use secure payment methods
Report fraudulent or suspicious activity immediately

6.3 Seller Responsibilities

Accurately describe the condition of items
Respond to buyer inquiries in a timely manner
Honor commitments made in listings
Not engage in bait-and-switch tactics or false advertising

6.4 Dispute Resolution

We encourage Users to resolve disputes amicably. White Africa may, at its discretion, mediate disputes but is not obligated to do so. We reserve the right to ban Users who repeatedly engage in fraudulent or abusive behavior.

7. Fees and Payments

7.1 Free Listings

Basic listings on White Africa are free, subject to certain limits on the number of listings per User.

7.2 Paid Features

We may offer paid features, including but not limited to:

Featured listings (promoted placement)
Membership subscriptions
Banner advertising
Verified seller badges

7.3 Payment Terms

All fees are non-refundable unless otherwise stated. We reserve the right to change our pricing at any time with reasonable notice.

8. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy. By using the Platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.

9. Prohibited Conduct

You agree not to:

Use the Platform for any illegal purpose
Impersonate any person or entity
Use automated systems (bots, scrapers) to access the Platform without authorization
Interfere with the proper functioning of the Platform
Attempt to gain unauthorized access to any part of the Platform
Collect personal information of other Users without consent
Engage in any activity that could harm the Platform or its Users

10. Intellectual Property Rights

10.1 Platform Content

All content on the Platform, including but not limited to text, graphics, logos, and software, is the property of White Africa or its licensors and is protected by intellectual property laws.

10.2 User Content

By posting content on the Platform, you grant White Africa a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and display your content for the purpose of operating and promoting the Platform.

11. Disclaimers and Limitations of Liability

11.1 No Warranty

The Platform is provided “as is” and “as available” without any warranties of any kind, either express or implied.

11.2 Limitation of Liability

To the maximum extent permitted by law, White Africa and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform.

11.3 Assumption of Risk

You acknowledge that transactions between Users involve inherent risks, and you agree to assume all risks associated with such transactions.

12. Indemnification

You agree to indemnify and hold harmless White Africa, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Platform or violation of these Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos, Nigeria.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify Users of material changes by posting the updated Terms on the Platform. Your continued use of the Platform after such changes constitutes acceptance of the new Terms.

15. Termination

We may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including breach of these Terms.

16. General Provisions

16.1 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.3 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and White Africa regarding the Platform.
